In August 2010, DePuy Orthopaedics recalled the ASR XL Acetabular System and the ASR Hip Resurfacing System. This recall was due to a “higher than expected” failure rate of those two hip replacement models. The ASR components, which were used in hip replacement surgeries in Ireland starting in 2003, have been associated with the dangerous release of metals into the bloodstream, causing patients to suffer from extensive tissue damage, possible bone damage, and pseudo-tumours. Symptoms caused by the defective implants are still being discovered and examined in many patients, but may include:
- Difficulty walking
- Numbness or loss of sensation in the leg
- A knocking or grinding sensation in the hip
- Stiffness or swelling of the leg
- Pain in the hip, leg, or groin
- Pain when rising from a seated position
- Pain bearing weight
DePuy Orthopaedics, Inc. is owned by the well-known Johnson & Johnson pharmaceutical company. They are one of the largest global providers of orthopaedic products, with sales last year in excess of €4 billion. DePuy has made sizable compensation payments in the United States when their products have been recalled in the past. It is therefore expected that compensation payments in Ireland will also be significant as a result of this latest recall.
Your Right to Compensation
If you have been fitted with a recalled DePuy ASR hip replacement system, you are entitled to compensation. This may include compensation for:
- Corrective surgery to replace a defective implant
- X-rays, blood tests, monitoring, and medical testing
- Lost wages
- Pain and suffering
- Loss of amenity
Be aware that DePuy Orthopaedics may try to contact you and offer to cover several of these costs directly, but you should not agree to this without first seeking the advice of an experienced medial malpractice solicitor. This is because DePuy will likely require that you sign consent forms and/or relinquish your medical records to them before they agree to cover any costs, and this can potentially extinguish your rights to greater compensation under Irish law.
DO NOT SIGN ANY PAPERWORK PROVIDED BY DEPUY without first speaking to an experienced solicitor. Doing so may extinguish your right to the fair compensation you are entitled to under Irish law.
